The Law Society is asking practitioners to complete an on-line survey to ascertain the views of the profession on the Jackson report and its proposals on litigation funding and solicitors costs.
Key proposals in the Jackson report include:
•preventing the recoverability of success fees and ATE insurance premiums
•an increase of 10% on general damage awards for pain, suffering and loss of amenity
•a 25% cap on the amount of a client's damages which can be deducted by their lawyer for the success fee (excluding any damages referable to future care or future losses)
•referral fees not to be permitted in personal injury claims
The Law Society are concerned that the proposals may affect access to justice and impact upon solicitors' business models. They are therefore asking practitioners to complete their short on-line survey.
The closing date for submitting the survey is 4 June 2010.
